Introduction

This Screenwriters Rights Association of India or "SRAI" is a company bearing CIN U91100MH2016NPL273040 registered under the Companies Act, with its registered office at 201 Vaibhav, Janki Kutir, Juhu Church Road, Mumbai – 400 049. This website, i.e. https://sraindia.org/ ("Website") is owned by SRAI.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our websites.

Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at office@sraindia.org so we can try to find a solution, if appropriate. These TERMS AND CONDITIONS ("terms and conditions") apply to (a) all visitors and (b) registered users of the Website.

References to "You", "Your", "End User" shall mean the user of the Website, and, "SRAI", "We", "Us" and "Our" shall mean Screenwriters Rights Association of India, our members our affiliates, licensees, agents, officers, employees, technicians and partners.

"Parties" shall mean You and Us, and "Party" shall mean a reference to either You or Us.

GENERAL TERMS

  1. By accessing, using and/or downloading materials from this Website you agree on your own behalf, and on behalf of each entity and person on whose behalf you act, to abide by these terms and conditions. SRAI reserves the right to change these Terms and Conditions at any time by posting changes online and it is your responsibility to refer to and comply with them on accessing the Website. Your continued use of this Website after changes are posted constitutes your acceptance of these Terms and Conditions as modified and that if you do not wish to be bound by the terms and conditions you should close the Website and cease to use/access/browse the Website and its services.
  2. SRAI reserve the right to generally add, remove or amend content or modify or terminate any or all of the services offered on this Website at any given time in the future without notice. SRAI shall not be liable to you or any third party for any modification to or withdrawal of the Website.
  3. These terms and conditions are separate from and do not alter or supersede in any way the terms or conditions of any other agreement You may have with Us, or Our subsidiaries or affiliates, for other Services or otherwise.
  4. This Website may also offer specific services which will have separate or additional terms of use applicable to them, and You agree to comply with any such additional terms of use where these are provided in relation to any service.

Communication Services

  1. By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at office@sraindia.org.
  2. The Website may contain services such as email, chat, WhatsApp, information related to recommendations, and other Service-related messages (hereinafter collectively referred to as "Communication Services"). The User agrees and undertakes to use the Communication Services only to send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, the User agrees and undertakes that when using a Communication Service, the User will not:
    1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others including SRAI.
    2. Send/upload files that contain software or other material protected by intellectual property laws unless the User owns or controls the rights thereto or have received all necessary consents.
    3. Send/upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or computer.
    4. Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
    5. Conduct or forward surveys, contests, pyramid schemes, or chain letters.
    6. Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
    7. Violate any code of conduct or other guidelines, which may apply for or to any particular Communication Service.
    8. Violate any applicable laws or regulations for the time being in force in or outside India, and violate any of the terms and conditions of this Agreement or any other terms and conditions for the use of the Website contained elsewhere herein.

Content and Services

Content found on or through this Service is the property of SRAI. In case you object with the content and wish to remove the said content you may mail us at office@sraindia.org or you may contact us at +91 9152343492

  • The User shall be liable to pay all applicable charges including internet handling charges, fees, duties, taxes, levies, and assessments for availing the Services, whenever the same is applicable (Applicable Charges).
  • User shall pay the Fee and Applicable Charges as specified by SRAI. Except as otherwise specified herein or in any specific case by SRAI. (i) Fees are based on purchase and not actual usage, (ii) payment obligations are non-cancellable, and Fees paid are non-refundable.
  • SRAI shall be entitled to terminate or suspend the Service in the event of nonpayment of the Fees and Applicable Charges.

Prohibited Uses

You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:

  1. If your usage in any way that violates any applicable national or international law or regulation.
  2. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
  3. To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
  4. To impersonate or attempt to impersonate SRAI, an SRAI employee, another user, or any other person or entity.
  5. In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
  6. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend SRAI or users of Service or expose them to liability.

Additionally, you agree not to:

  1. Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real time activities through Service.
  2. Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.
  3. Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent.
  4. Use any device, software, or routine that interferes with the proper working of Service.
  5. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
  6. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service, the server on which Service is stored, or any server, computer, or database connected to Service.
  7. Attack Service via a denial-of-service attack or a distributed denial-of-service attack.
  8. Take any action that may damage or falsify SRAI rating.
  9. Otherwise attempt to interfere with the proper working of Service.
  10. Not to create a link to any web page of this Website without SRAI’s prior written consent or authorisation.
  11. In cases where the SRAI has reason to believe there has been a breach of these terms and conditions, or that our intellectual property rights have been infringed, your access to this Website may be suspended or terminated by SRAI at any time with or without notice.

Limitation Of Liability

Governing Law, Jurisdiction and Dispute Resolution

  1. These Terms shall be governed and construed in accordance with the laws of India, which governing law applies to agreement without regard to its conflict of law provisions. The place of jurisdiction will be Mumbai, India.
  2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.
  3. The Parties hereto agree and undertake to make reasonable efforts to settle any Dispute in an amicable manner. Additionally, a Party of the Dispute may deliver a notice of the Dispute to the other Party mentioning the particulars of the Dispute and any proposed or accepted reasonable course of action to amicably settle the Dispute.   4. To the extent practicable, the Parties shall continue to work together in respect of performance of these terms and conditions, pending the final outcome of any Dispute.

Changes To Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users.

Amendments To Terms

We may amend Terms at any time by posting the amended terms on this App. It is your responsibility to review these Terms periodically.

Force Majeure

Neither SRAI nor any Producer shall be liable for any failure or delay in performance of its obligations under this Agreement arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, without limitation, acts of God, natural disasters, wars; civil or military disturbances, sabotage, strikes, epidemics, riots, power failures, computer failure, loss or malfunction of utility, transportation, computer (hardware or software) or telephone communication service, accidents, labour disputes, acts of civil or military authority, governmental actions, or inability to obtain labour, material, equipment or transportation.

Acknowledgement

BY USING SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
